Here are some helpful FAQs about art licensing with Brixta Studio:
Q: Do I need a license to sell products I made from fabric with your design that I bought on Spoonflower?
A: No. As long as you are buying the fabric or wallpaper on Spoonflower, you don’t need to license it to sell as many products aa you want with my design. But if you want to use a different printer, you will need a license.
Q: What is art licensing?
A: Art licensing is like renting the artwork, either exclusively or non-exclusively. The licensee pays a fee to the licensor (artist) to use the artwork according to the terms mutually agreed upon.
Q: What is the difference between a non-exclusive license and an exclusive license?
A: A non-exclusive license is where you can put the design on your own product for resale in one category, using your printer of choice. In this case, the same design can be licensed non-exclusively by other companies at the same time, and also be sold on Spoonflower on wallpaper, fabric and home decor.
An exclusive license is where the licensee and licensor agree to terms of time duration, product category, and/or geographical region. This allows me, the designer, to also exclusively license the artwork to another party in a different category and/or region during the same time period. At the end of the term, the license can be re-negotiated to benefit both sides. If you don't renew it, the rights revert back to me, the artist.
Q: Who owns the copyright when a design is licensed?
A: As the artist, I own the copyright to the work (including all derivatives) before, during and after the license period.
Q: Are your designs seamless?
A: Yes they all repeat seamlessly on all 4 sides.
Q: Do you take scale change requests?
A: Yes I can always scale down, but it depends on the design whether I can scale up or not.
Q: Do you take color change requests?
A: Yes I do.
Q: What is your licensing fee?
A: This is negotiable depending on many factors. Generally it is either flat fee up front, a royalty rate per item you sell, or a combination of royalty rate plus advance.
